How can you qualify or an EB-1 or EB-2 Visa?

California is an exceptionally popular state for immigrants, and with the state’s immigrant population constantly booming, many have wondered how you can qualify to get an EB-1 or EB-2 Visa. Here’s an overview.

EB-1 Visa

An EB-1 Visa is available to an immigrant or alien “of extraordinary ability.” This is part of the United States’ ongoing efforts to recruit the best and brightest from across the world to live and work in our country. It is given to individuals based on their employment status. To qualify, you must have:

  • An extraordinary ability in a field like business or athletics.
  • Have made outstanding achievements in a particular academic field.
  • Be employed outside of the United States.

In all of these instances, your word isn’t good enough, and you must be able to provide documentable proof that you meet these qualifications.

EB-2 Visa

An EB-2 Visa is similar to an EB-1 visa. You have to meet some extremely difficult criteria, but it is not as competitive or extraordinary as an EB-1 visa. Qualifications include:

  • Possessing an advanced degree and working for a company that requires that degree.
  • Having obtained a National Interest Waiver, which means that your area of employment is of special interest to the United States.

Just like for the EB-1 visa, you must provide proof that you meet any of the criteria for which you are applying.
