What is employment-based immigration?
Employment-based immigration is the large body of visas and options that allow for temporary or permanent visas that allow foreign nationals to reside in the U.S. These visas, by and large, are sponsored by employers on behalf of their non-U.S. citizen employees.
What types of employment-based visas are available?
There are two main categories: non-immigrant visas (temporary) and immigrant visas (permanent). Non-immigrant visas are for those who expect to return to their home countries once the work is done; these include temporary workers on a contract and H-1B, L-1, E-2 visas.
Immigrant visas are for those who would need to stay in the U.S. long term, such as foreign investors or necessary employees who can have an EB-1, EB-2, and EB-5 for immigrant visas.
What is the difference between non-immigrant and immigrant visas?
We’ve touched on this in the previous two questions, but the major difference is the avenues for permanent residence and even citizenship. Immigrant visas – even employment-based ones – can provide some avenues for a person to become a citizen.
