What is the EB1 visa?

The EB1 visa, also known as the Employment-Based First Preference visa, is a green card that allows immigrants to live and work in the United States. One of five employment-based visas available under the U.S. immigration system, it is reserved for individuals who:

• Have extraordinary ability in their field
• Demonstrate that their skills are needed in the United States
• Show that they will be able to financially support themselves and any dependants without relying on public assistance

What are the benefits of an EB1 visa?

The main benefit of an EB1 visa is that it allows you to live and work in the United States for as long as you want. You can easily apply to adjust your status to permanent residence if you have this visa. You will also have access to all of the same benefits as other green card holders, including health care, education, and Social Security. Additionally, your spouse and children under 21 years old will be able to join you in the United States.

How do you apply for an EB1 visa?

To apply for an EB1 visa, you will need to file a Form I-140, Petition for Alien Worker. You can file this form either with the U.S. Citizenship and Immigration Services or with a U.S. embassy or consulate abroad. You will also need to provide extensive documentation supporting your claim of extraordinary ability.

The EB1 visa is not common or given out lightly. Typically, obtaining one requires significant effort and preparation to build a strong case.
